Agreement to Terms

By accessing or using the Who's My Competitor browser extension and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Who's My Competitor is a browser extension that provides competitor analysis tools for cycling race participants. The Service allows users to:

  • Analyze competitor race history and results
  • View race placements and statistics
  • Access strategic insights and recommendations
  • Export and manage competitor data

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated systems (bots, scrapers) to access the Service excessively
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to harass, abuse, or harm other users
  • Impersonate any person or entity or misrepresent your affiliation

Subscription Plans and Billing

Free Plan

The free plan ("Scout") provides limited access to competitor analysis features with usage limits as specified in our pricing documentation.

Paid Plans

Paid subscription plans ("Pro Racer" and "Coach/Team") are billed monthly. By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your selected plan
  • Automatic renewal unless cancelled before the billing period ends
  • Price changes with 30 days' notice

Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. Refunds are provided at our discretion and may be subject to our refund policy.

Usage Limits

Your use of the Service is subject to usage limits based on your subscription plan:

  • Free Plan: 3 analyses per week, 12 analyses per month maximum
  • Pro Plan: 50 analyses per month
  • Coach/Team Plan: 250 analyses per month

Exceeding these limits may result in temporary suspension of service or a request to upgrade your plan.

Intellectual Property

The Service and its original content, features, and functionality are owned by Who's My Competitor and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

Third-Party Content

The Service may display, include, or make available content, data, information, or materials from third parties ("Third-Party Content"). We do not endorse or assume responsibility for Third-Party Content. Your use of Third-Party Content is at your own risk.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results or data provided are accurate, complete, or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHO'S MY COMPETITOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Indemnification

You agree to defend, indemnify, and hold harmless Who's My Competitor and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Who's My Competitor operates, without regard to its conflict of law provisions.
